Breaking: NIC Judgment: Sacked/Reinstated CSC Members set to file garnishee action suit against Fintiri

Members of the Adamawa state civil service commission (CSC) board sacked by Gov. Fintiri of Adamawa state in 2019 has finalised plans to institute a class action against the Adamawa state government for its failure to honour the judgement of the National industrial court ordering the reinstatement of  the sacked members of the board.

A member of the CSC sacked by Gov. Fintiri told THE FINDER on Thursday on a condition of anonymity that the class action was aimed at securing a court order to compel the Adamawa state government to pay their salary arrears as since their reinstatement by the court no single kobo has been given to them as salary till date.

“We’ve put our papers together, we’re ready, we are making an application for an order of garnishee against the state government to respect the judgement of the court by paying us our pending salaries from the month of the sack till date, the source said.

“We needed to make it a class action, let it not be that only we because in this era where people think that anything you do to challenge government is because you want to be settled.”

Last month, the group issued a notice to the Adamawa state government through the office of the Adamawa state attorney general and commissioner for justice, Barr. Jingi, demanding the enforcement of the industrial court judgement.

It also demanded an investigation into what it described as the collusion of silence by the Adamawa state ministry of justice and the attorney general on the execution of the judgment.

It was widely reported penultimate week that the Adamawa state attorney general and commissioner for justice told the sacked and reinstated members of the board to do whatever they want if the judgment is not enforced.

The Finder reports how the national industrial court grants order of garnishee proceeding against the Adamawa state government accounts due to serial disobedience of its judgement to reinstate Batch D workers allegedly sacked in 2014 when Fintiri was the acting governor of the state.
