Tonye Cole’s appeal against Fubara dismissed by the Supreme Court.
Tonye Cole and the All-Progressives Congress (APC) had their appeal against Siminalayi Fubara’s election as governor of Rivers State rejected by the Supreme Court because it was found to be without substance.
Among other things, the court found that the appellant failed to provide sufficient evidence to support the claims of Electoral Act non-compliance.
The court deemed the appeal to be incompetent and rejected it.
The APC candidate in the March 18, 2023, election, Cole, was contesting Governor Fubara’s victory because, according to Cole, Fubara did not retire as Rivers State’s accountant general prior to the election.
Cole listed several things, including suspected anomalies, corrupt acts, and failure to comply with the Electoral Act.
He wanted the rulings of the Tribunal and the Court of Appeal reversed since they had supported the People’s Democratic Party’s (PDP) Fubara’s victory in the Rivers governorship election.
